Framework contract for consultancy services in EU public procurement law

Consultancy services for completeness and compliance checks of national transposition measures and other legal assessment services in the field of EU public procurement law.

Following EU countries' formal notification of national transposition measures, the European Commission is seeking an assessment on the completeness of the transposition of EU Public Procurement Directives (i.e. Directive 2014/23/EU of the European Parliament and of the Council, Directive 2014/24/EU of the European Parliament and of the Council, Directive 2014/25/EU of the European Parliament and of the Council). It is also seeking comprehensive and in-depth legal analysis about the compliance of national transposition measures with the EU Directives and the translation of these national measures into English. Moreover, the Commission may request a legal analysis concerning the national provisions that — in regulating public procurement issues and within the respect of EU rules — go beyond the scope of the EU Directives (for more details, see the technical specifications). 

The Framework Contract on 'consultancy services for completeness and compliance checks of national transposition measures and other legal assessment services in the field of EU public procurement law' establishes the basic terms for a series of subsequent orders/specific contracts. The aim of these orders/specific contracts shall be to:

• define the tasks to be carried out by the contractor concerning the completeness assessment; the translation and the compliance assessment; and, when required, the legal assessment of accompanying national provisions which – in regulating public procurement issues and within the respect of EU rules in that field– go beyond the scope of the EU Directives.
• identify the Public Procurement Directives for which the relevant assessments are needed (i.e. Directive 2014/23/EU, Directive 2014/24/EU and Directive 2014/25/EU).
• identify the EU countries covered following the formal notification to the Commission of national transposition measures.
